End User License Agreement (EULA)

Effective Date: July 27, 2026

This End User License Agreement (“Agreement”) governs your use of the GasLight Dispensary mobile application (“Application”) provided by Green Empire Wellness LLC d/b/a GasLight Dispensary (“GasLight,” “we,” “us,” or “our”).

By downloading, installing, accessing, or using the Application, you agree to be bound by this Agreement. If you do not agree to this Agreement, do not download, install, or use the Application.

This Agreement applies to the GasLight Dispensary mobile applications available through the Apple App Store, Google Play Store, and any other authorized distribution platform.

1. Application Ownership

The Application is owned and operated by:

All rights, title, and interest in and to the Application, including all software, designs, graphics, trademarks, logos, content, and related intellectual property, are owned by or licensed to GasLight Dispensary.

2. License Grant

Subject to your compliance with this Agreement, GasLight Dispensary grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application solely for your personal, lawful use.

This license does not grant you ownership rights in the Application or any content provided through the Application.

3. Eligibility Requirements

The Application is intended only for individuals who are legally permitted to access adult-use cannabis services.

You must:

  • Be at least twenty-one (21) years of age.
  • Be legally permitted to purchase adult-use cannabis products.
  • Provide accurate account and verification information.
  • Comply with all applicable cannabis laws and regulations.

GasLight Dispensary reserves the right to restrict access to users who fail age verification requirements or violate applicable laws.

4. Permitted Use

You may use the Application to:

  • Browse available cannabis products.
  • Create and manage a customer account.
  • Place orders where available.
  • View order history.
  • Manage loyalty rewards.
  • Receive promotional communications where permitted.
  • Access store information and updates.

5. Prohibited Activities

You agree that you will not:

  • Copy, modify, reverse engineer, or attempt to extract source code from the Application.
  • Use the Application for illegal purposes.
  • Allow another person to access your account.
  • Attempt to bypass security features.
  • Interfere with Application functionality.
  • Upload malicious software or harmful content.
  • Use automated tools to access or collect information from the Application.

6. Account Responsibility

Certain features of the Application may require account registration.

You are responsible for maintaining the confidentiality of your login information and all activity associated with your account.

You agree to immediately notify GasLight Dispensary if you believe your account has been accessed without authorization.

7. Cannabis Compliance

The Application provides access to adult-use cannabis retail services operated under applicable New York cannabis regulations.

You acknowledge and agree that:

  • Cannabis products are restricted to individuals 21 years of age or older.
  • Product availability is subject to applicable laws and regulations.
  • Orders may require identity verification.
  • GasLight Dispensary may refuse or cancel transactions when required by law.
  • Cannabis products cannot be transported or transferred in violation of applicable laws.

8. Location Services

The Application may request access to location information to provide enhanced features, including store information, delivery availability, and location-based services.

You may disable location permissions through your device settings; however, certain Application features may not function properly without location access.

9. Push Notifications and Communications

With your permission, the Application may send push notifications regarding:

  • Order updates.
  • Promotions.
  • Loyalty rewards.
  • Store announcements.
  • Important account information.

You may manage notification preferences through your device settings.

10. Third-Party Services

The Application may integrate with third-party services, including but not limited to:

  • Dutchie ordering and cannabis retail technology.
  • Alpine IQ customer engagement and loyalty services.
  • Payment processing providers.
  • Analytics providers.
  • App distribution platforms.

GasLight Dispensary does not control and is not responsible for third-party services, availability, security, or privacy practices.

11. Payments

The Application may allow customers to complete transactions through third-party payment providers.

Payment information is processed according to the applicable payment provider’s terms and privacy policies.

GasLight Dispensary does not store complete payment card information unless expressly disclosed in our Privacy Policy.

12. Updates and Modifications

GasLight Dispensary may update, modify, or discontinue portions of the Application at any time.

Updates may be required to continue using certain Application features.

You agree that continued use of the Application after updates constitutes acceptance of any modifications.

13. User Content

If the Application allows users to submit reviews, comments, photographs, ratings, or other content (“User Content”), you grant GasLight Dispensary a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content for business purposes.

You represent that:

  • You own or have permission to submit User Content.
  • Your content does not violate any law or third-party rights.
  • Your content does not contain misleading, offensive, or unlawful material.

GasLight Dispensary reserves the right to remove User Content at its discretion.

14. Apple App Store Terms

If you download the Application through the Apple App Store, you acknowledge that:

  • This Agreement is between you and GasLight Dispensary, not Apple.
  • Apple has no obligation to provide support services for the Application.
  • Apple is not responsible for the Application or its content.
  • Apple may enforce this Agreement as a third-party beneficiary.

15. Google Play Terms

If you download the Application through Google Play, you acknowledge that:

  • Your use of the Application is subject to this Agreement.
  • Google is not responsible for the Application’s operation or content.
  • Google is not responsible for customer support obligations.

16. Disclaimer of Warranties

THE APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

GasLight Dispensary does not guarantee that:

  • The Application will always be available.
  • The Application will be error-free.
  • Information provided through the Application will always be complete or accurate.
  • The Application will meet every user’s requirements.

17. Limitation of Liability

To the maximum extent permitted by law, GasLight Dispensary shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Application.

This limitation applies to loss of data, business interruption, lost profits, or damages resulting from third-party services.

18. Termination

GasLight Dispensary may suspend or terminate your access to the Application if you:

  • Violate this Agreement.
  • Engage in fraudulent activity.
  • Misuse the Application.
  • Violate cannabis regulations.

Upon termination, your license to use the Application immediately ends.

19. Governing Law

This Agreement shall be governed by and interpreted under the laws of the State of New York, without regard to conflict of law principles.

20. Dispute Resolution

Any dispute arising from this Agreement or your use of the Application shall be resolved through binding arbitration, except where prohibited by applicable law.

You agree that disputes will be resolved individually and not as part of a class action, collective action, or representative proceeding.

21. Changes to This Agreement

GasLight Dispensary may update this Agreement periodically. The updated version will be posted through the Application or website with the revised effective date.
